CONTEST TERMS AND CONDITIONS
1. BY PARTICIPATING IN THIS CONTEST, YOU (HEREINAFTER REFERRED TO AS “PARTICIPANT(S)”) AGREE TO BE LEGALLY BOUND BY AND ABIDE BY THE TERMS & CONDITIONS STATED HEREIN. PLEASE READ THESE TERMS & CONDITIONS (“T&C”) CAREFULLY BEFORE REGISTERING TO PARTICIPATE IN THIS CONTEST KNOWN AS “Cash Mania Contest (“CONTEST” / “CHALLENGE”) . BY PROCEEDING WITH REGISTRATION AND PARTICIPATION IN THIS “Cash Mania Contest ”, YOU HEREBY ACKNOWLEDGE AND ACCEPT THE TERMS AND CONDITIONS AND THEREBY AGREE ON IRREVOCABLE BASIS, TO BE LEGALLY BOUND BY THESE TERMS & CONDITIONS. IF YOU DO NOT AGREE TO ABIDE BY THESE TERMS & CONDITIONS, PLEASE DO NOT PARTICIPATE IN THIS CONTEST.
2. The Contest is conceptualized, organized and conducted by One97 Communications FZ-LLC (license No. 18644), having its main office at Executive office no 106, First Floor, Building No. 11, Dubai Internet City Dubai, UAE. (hereinafter referred to as “One97”) in association with Emirates Integrated Telecommunications Company, PJSC, registered at the Dubai Department of Economic development and Commercial register number 77967, with its main office at Dubai Media City , Al Salem Tower, PO Box 502666, Dubai , U.A.E (hereinafter referred to as “du”)
3. [ONE97] and du shall hereinafter be jointly or individually, as the context may require, be referred to as “ Organizer/s ”.
Eligibility Criteria to participate:
1. This Challenge is available only to the Active Subscribers of du (prepaid/postpaid) and who fulfill the following criteria:
  - Subscriber must be of or above 18 years of age;
  - Subscriber must be a citizen of or residing in Dubai;
  - Subscriber must not have been either convicted and / or prosecuted for commission of any criminal offence nor be of an unsound mind;
  - Subscriber must not be under any legal disability e.g. insolvency, restraint by court order etc. and / or is prohibited from entering any contractual relationship.
2. Active Subscribers of Du who fulfill the above eligibility criteria and Participate in/register for the Challenge shall hereinafter be referred to as “Participant/s/ Subscriber”. The employees of the Organizers and of their group companies or associate companies, along with their family members/relatives, shall not be eligible to participate in the Challenge.
3. By participating in this Challenge, You/Participant:
  - Warrant that you have read understood and agreed to conform to these Terms and Conditions.
  - Warrant the accuracy, truthfulness and currency of all information that You have submitted.
  - You are acting voluntarily, using your own time and resources to participate in the Challenge solely at your own risk.
4. These Terms and Conditions are available on the website at the following address: [http://one97.com/contest/du/index.html (“Website”). The Terms and Conditions can be amended or varied from time to time or withdrawn and therefore, please visit the Website periodically to keep yourself updated and informed.
Nature of Challenge Procedure, Winner Selection Criteria and Gratification
1. The Challenge is available on IVR, SMS, USSD and OBD only.
2. Registration - USSD and OBD modes will only be used for activation/deactivation of the contest. User can send *111*36# and activate the contest via USSD. The Organizer at its sole discretion may send OBD to the Participants to continue with the Challenge. The Challenge runs by sending an SMS <CASH or WIN or A or B> to 9820 toll free. User can also register and play through OBD mode.
3. Participation - Contest can be played via SMS or IVR mode or OBD irrespective of the mode used by user for subscription. the Participant will be successfully registered for the Challenge. Customer post sending the registration keywords i.e. CASH/WIN/A/B will be activated on Try N Buy pack at zero price points with allotment of five (5) free questions for a day. After playing 5 questions, customer will be auto renewed and charging will get initiated. A user can be activated on Try N Buy pack (five questions at zero price point) only once in entire challenge period, including re-subscriptions. Active Customers can play both free and PPQ questions via OBD as well and inactive customer can only play PPQ questions via OBD & SMS mode
4. All questions are in multiple choice format with two (2) options and the answer to each must be selected from one of the two (2) options only. For every right answer, the Participant will get [100] points. There is no negative marking for a wrong answer but user will get 50 free points for every wrong answer.
5. [Unlimited] skill based questions. [5] Questions per day. Post registration, send SMS [PLAY to 9820 toll free or by dialing IVR on 800156].
6. After every answer, the Participant will be given an appropriate response followed by the updated score and given the next question and answer options. Post all the subscription questions for the day are over, user can play more questions on PPQ model at 0.50 fils/question.
7. If a Participant doesn’t reply to any question within that particular day, then the question will get expired. To receive the same question and continue with the Challenge, Participant should [send SMS <PLAY> to 9820 toll free], post which Participant will receive the nth question. If the Participant does not receive question for any reason, the same process has to be followed.
8. Unsubscription - The Participants may discontinue participating in the Challenge anytime by sending SMS DEACT to 9820 toll free or by dialing IVR on 800156 Participant can subscribe and unsubscribe to the Challenge any number of times during the Challenge validity. There would be daily gratifications also in the contest basis the higher scorer and/or selection criteria of the day. On every renewal participant to get bonus points as per grid mentioned below.
** In case OBD or SMS is sent to the inactive customers then user will only be eligible to play on PPQ mode at 0.50 fils / question without subscribing/registered to the service.
- For In-active customers playing procedure on SMS mode.
  1. An eligible inactive customers to get ‘welcome’ Q&A message with reply A/B to take part in PPQ Challenge by answering to first question through SMS and continue playing contest challenge without any subscription/registration during entire competition period.
  2. Once customer replies with A or B, then user will be charged for 0.50 fils/ques in PPQ model, and continue to play an infinity of questions. For every right answer, the participant will get 100 points, there is no negative marking for a wrong answer but user will get 50 free points for every wrong answer.
  3. After every answer, the participant will be given an appropriate response followed by the updated score and given the next question with answer options during entire challenge period.
  4. If a participant doesn’t reply to any question within that particular duration, then the question will get expired. To continue with the Challenge, participant should send “PLAY to A or B or PLAY to 9820 toll free to resume next question.
  5. This inactive customer can play an infinity of questions without subscribing/registered to this service.
- For In-active customers playing procedure on OBD mode.
  1. An eligible inactive customers will get an Out Bound Dialler (“OBD”) call, where customer will be asked to play the challenge questions with 2 answer options, press 1 for 1st option or 2 for 2nd option on the phone keypad to answer the question.
  2. Once customer replies with 1 or 2, then user will be charged for 0.50 fils/ques in PPQ model, and continue to play an infinity of questions. For every right answer, the participant will get 100 points, there is no negative marking for a wrong answer but user will get 50 free points for every wrong answer.
  3. Customer will be played an appropriate prompt with his/her updated score and given the next question with answer options during the entire challenge period.
  4. This inactive customer will be given an infinity of questions one after the other without subscribing/registered to this service.
Winner selection criteria
- For all gratification categories (except Daily Winners) - The process of selection of Probable/Tentative winners (top twenty basis winner selection criteria mentioned below under Daily Winners, subject to successful charging**) for each category of gratification will be witnessed by One97 and will be shared with operator who would communicate it to the Dubai DED (Department of Economic Development) and DED shall take out the winners via random selection from the data.
- Daily Winners - Winners will be declared by organizer on a skill based scenario basis following winner selection criteria, subject to successful charging**:
  - Tie Breaker (Daily Winners) - In case of a tie between Participants on above mentioned criteria, the participants who have tied will be asked to answer a set of 5 tie breaker questions. The participant who answers the maximum questions correctly in the given time or in case all the tied participants correctly answer equal number of questions the participant who answers the maximum questions correctly in the least time, will be selected as the winner. This shall continue till a clear winner selection can be done. Tie breaker will not be applicable for recharge prizes

One Participant (MSISDN) can win more than one prizes by achieving higher score/points. However, he/she can win prize of a prize category only once. This clause shall not be applicable on Airtime E-recharge prize category.
One MSISDN can win Airtime E-recharge prize more than once.
The Winners’ names will be announced as registered in the system of Du, subject to applicability. If winner details including Name or Address are incomplete in records maintained by the operator, then it will be the winner’s responsibility to get them updated with the operator before claiming the prize. The details registered with operator shall match with the documents received from the winner.

Challenge Period
The Challenge is open for a limited period from [6^th February 2023] 00:00:01 hours to [6^th April 2023] 23:59:59 hours (referred as Challenge Period) both days inclusive.

*The charged amount will not be refunded to Participant(s) under any circumstances.

* If a customer is activated/renewed for contest on zero amount then in such case customer will not be able to play subscription questions for the day but can continue to play PPQ questions at 0.50 fils / question charging. Questions will not be carried forwarded to another day in the Challenge Period.

*Participant can answer the questions of any missed days of the Challenge after paying charges for the missed questions. Missed days of Challenge means such days of the Challenge when a Participant could not continue with the Challenge for any reason whatsoever.

**Free Points will be awarded to participants on registration & renewal/charging as per grids mentioned above.

Other terms & conditions:
1. Sponsor - The gratifications offered in this Challenge are sponsored and distributed by the [ONE97]. Du is only providing information and data in relation to the Active Subscribers to facilitate the Challenge.
2. Winner Communication - The eligible winner will be contacted/communicated through call/SMS/email for [15] days from the announcement of Challenge results. The Challenge results will be announced within 45 days post completion of contest period. However in case of daily gratification, the communication about the eligible winner and the disbursement thereof will be done within 15 working days of the relevant day. Failure on the part of eligible winner to acknowledge the email/SMS/call as stated herein above or to redeem the gratification at the time of delivery or to accept the gratification will entitle the Organizer to forfeit the gratification at its sole discretion and such gratification shall be deposited with the DED officials. If it is noticed that any of the Participant who is selected as the eligible winner of the Challenge, is an existing employee of the Organizers or of their group companies/ /associate companies, then Organizer will forfeit the gratification of such eligible winner and such gratification shall be deposited with the DED officials. The names of eligible winner will be announced as registered in the system of Du. The list of the eligible winner of the gratification will also be published on the Website.
3. Tax Applicability -. All gratification will be given in cash/cheque/bank draft shall be subject to deduction of applicable taxes, license fees, cess and duties, statutory permit charges, or such other fees (by whatsoever name referred) and shall be effective as per the prevailing laws & regulations of Dubai, either on prospective or retrospective effect (as the case may be). All incidental costs (i.e. costs for collecting gratification including insurances, costs for including any update or for modification fees, transfer fees, registration fees, all the expenses over ex-showroom price etc., in case of vehicle/car offered as gratification) /charges/taxes/levies which may include and not be limited to withholding taxes, Gift tax, road tax, property tax, environment tax and cess, any other taxes levied by the federal / state or municipal bodies, Insurance charges as may be applicable and any other fees (by whatever means prospective or retrospective) related to the gratification(s), if any, shall be exclusively borne by the eligible winner including Further if any VAT shall be payable to Dubai VAT Authority on the said gratification under any reverse charge as per the prevailing laws & regulations of Dubai, either on prospective or retrospective effect (as the case may be), shall be recovered/collected from Winner only and shall be borne by such winner.
4. The Organizers may use sub-contractors or third party vendors to execute certain tasks associated with this Challenge.
5. The Organizers shall not be responsible for any delay on part of a third party including the courier agency in delivering the gratification.
6. DND subscribers will not be sent any engagement SMS/engagement OBD as DND subscribers themselves have to discover about the Challenge. By entering the Challenge, You confirm and waive the applicability of rules and regulations of the National Do Not Call Registry and You agree to receive alerts including without limitation any updates regarding the present Challenge.
7. The Participant hereby understands and gives his/ her irrevocable consent to One97 and Du to use, the details of the Participant such as name, the prizes awarded to them, phone number(s)(Last 4 digits of mobile number), score(s) and/or photographs of Subscribers, if required, and specifically, of winners for the purpose of media coverage and alike activities. The Participants also consent to the information being processed and stored in the servers of [ONE97] or its service providers.
8. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in the Website and all material or content related to the Challenge shall at all times be owned by the Organizers and/or their respective owners. All material and content on the Website is made available for your personal and non-commercial use only. Any other use of the material/ content available on the Website and/ or any information disseminated by SMS or any other means of communication is strictly prohibited.
9. The Organizers are neither responsible nor guarantee the quality of the goods or services being offered as gratification nor are they liable for any defect or deficiency in goods or services offered as gratification under this Challenge. The Participants shall not have the right to claim any damages, loss or costs from the Organizers for delay in delivery of the gratification(s) on any grounds whatsoever. The pictures of gratification depicted on the Website/promotional material are only indicative and the actual gratification may vary from the depictions.
10. In case of gratification in the kind, where under the prevailing rules & regulations of Dubai Law, if any WHT/Tax has to collected/deducted from Winner, the same shall be collected/deducted from winner only and shall be borne by winner.
11. The Organizers make no representation of having a business relationship or tie up with any such companies, individuals or any other organization whose products are offered as gratifications in the Challenge. All trade names shall continue to remain owned by their respective owners.
12. Subject to any applicable law (a) All warranties of any kind whatsoever, whether express or implied, are hereby expressly DISCLAIMED by the Organizers including, but not limited to, meeting of the Participant's requirements or aspirations with respect to Challenge, timeliness, security, delivery, quality, merchantability or fitness of telecom/internet services, non-disruption or error free operation of telecom/ internet services , delivery, quality, quantity, merchantability, fitness for use or non-infringement in respect of any goods/services/merchandise/benefits/ awards offered through the Challenge; and (b) No advice or information whether by representations, oral, written or pictorial derived from the Website or through the Challenge shall be construed to mean the giving of any warranty of any kind by the Organizers.
13. Organizer shall also make 3 alternative Call or SMS or Email attempts to contact Winners to inform about the prizes and further process of claiming the prizes. The Winner have to submit the documents within 10 days post the Organizer contacts the winner through Call or SMS or Email and last timeline to submit the documents will be informed to winners on last attempt through Call or SMS or Email.
14. The gratification(s) shall be given subject to compliance by the eligible winner of all the applicable statutory legislations, processes and formalities and production of all relevant documents/papers as may be required by the Organizers before accepting the delivery of the gratification. Any failure on the part of the eligible winner to comply with directions issued by the Organizers including submission of relevant documents and within 10 days from the date of call/email/SMS from Organizers for claiming gratification shall entitle the Organizers to forfeit the gratification(s) and such gratification shall be deposited with the DED officials, at their sole discretion.

16. The gratification(s) under this Challenge are neither assignable nor transferable under any circumstance, unless specifically provided hereunder. No other person or agent can claim the gratification on behalf of the eligible winner, unless otherwise expressly mentioned herein. Apart from the entitlement to the above gratification(s), the eligible winner or his/her legal heirs/successors/representative will have no other rights or claims against the Organizers.
17. Organizers at their sole discretion reserve the right to substitute gratification(s) of equal or of value not more than gratification value at any time. However under no circumstance shall the eligible winner of the Challenge be entitled to redeem any category of gratification for cash.
18. To claim gratification/s under the Challenge, the MSISDNs/Participants chosen as the eligible winner as declared by the DED, shall be required to be Active Subscribers of Du. The eligible winner as declared by the DED, shall not be entitled to the gratification in case he/ she fails to clear all outstanding dues payable to Du.
19. Any Participant providing any incorrect information or concealing/withholding any information from the Organizers with an intent to participate and/or be chosen as the eligible winner of the Challenge will automatically be disqualified from participating in it and being chosen as the eligible winner. Such act of providing incorrect information or concealing/withholding any information, including without limitation incorrect declaration of information relating to name, age, identity, address, mobile connection of Du number, domicile, payment of outstanding amount to Du or any other information provided by the Participant, shall entitle the Organizers to disqualify him/her without any further intimation.
20. You shall indemnify and keep indemnified the Organizers and their officers, directors, employees, and harmless from and against any and all claims, losses, suits, proceedings, action, liabilities, damages, expenses and costs (including attorney’s fees and court costs) which the Organizers may incur, pay or become responsible/liable for as a result of your breach or alleged breach of the representations or obligations under the Terms and Conditions hereunder, your failure to comply with applicable law and any third party claim in respect of misuse of any information of a third party.
21. The Organizers and/or their respective, directors, officers, employees, shall not be held responsible and liable for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, that may be incurred or for any personal loss or injury that may be suffered (including loss of life), by a Participant and/or eligible winner and/or any third party, directly or indirectly, by reason of Challenge or the Challenge gratification(s). In no event, the entire liability of One97 for any dispute arising in connection with the Contest shall exceed the gratification amount that the Participant(s) is entitled to under the said Contest.
22. The Organizers shall not be responsible for any claims arising out of any failure(s) which is beyond their control. Without limiting the generality of the foregoing, the Organizers shall not be responsible for any claims arising out of technical failures before, during or after the completion of the Challenge including but not limited to any technical failures in the mobile connectivity, delay in sending or receiving the SMS for participating in the Challenge, delay in time recorded or taken for answering a question during the tie-breaker process, any action that has been initiated, actioned or completed through his/her mobile phones, failure of servers or the failure to provide the correct score updates or any failures arising out of technical snags or resultant inability of the listener for participation.
23. You hereby agree and undertake not to hold the Organizers and/or any of their or, their respective directors, officers, employees, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or indirect or remote that they may/might have suffered, sustained or incurred, or claim to suffer, sustain or incur, by way of and /or on account of this Challenge.
24. The gratification shall be handed over or deliver by [ONE97] on receipt of all the documents from the eligible winner as declared by the DED official on random basis,
25. This Challenge including the gratification thereof cannot be used in conjunction with any alternative offer or promotion of a similar nature.
26. This Challenge is subject to force majeure circumstances including without limitation, epidemic, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the possible control of the Organizers (“Force Majeure Event”). The Organizers shall not be liable for any delay or adverse effect caused to Challenge as a result of a Force Majeure Event. The Organizers shall intimate the suspension of the Challenge caused as a result of such Force Majeure Event to the Participants when possible.
27. The Terms and Conditions stated herein shall not override the terms and conditions of the Subscriber Enrolment as submitted by customer while purchasing the number.
28. The decision of the DED officials in respect of all transactions under this Challenge including without limitation the selection of the eligible winner shall be final and binding.
29. Questions and their answers, designed/sourced by the Organizers, are as per their best knowledge and information available at public large and have been collected and framed with best possible prudence. In case there is any discrepancy or dispute regarding the questions or answers, neither the Organizers nor any third party involved shall have any liability towards any Participant.
30. The Organizers reserve the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this Challenge or any part thereof including the eligibility criteria, the Terms and Conditions and gratification at their sole discretion at any time during its validity as may be required including in view of business exigencies and/or changes by a regulatory authority and/or statutory changes and/or any reasons beyond their control and the same shall be binding on the Participants. The latest revised version of the Terms and Conditions shall be effective and binding on the Participant from the time of its posting on the Website. You are therefore advised to check the Website regularly for any update(s) or amendment(s) made to these Terms and Conditions and in the event the modified or amended Terms and Conditions are not acceptable to You, You should discontinue participating in the Challenge.
31. The Organizers reserve the right, at any time, to unconditionally disqualify any Participant who tampers with or who in any way abuses the process or Terms and Conditions of the Challenge, without giving any prior intimation to such Participant. Failure by the Organizers to enforce any of their rights at any stage does not constitute a waiver of those rights.
32. Any attempt by a Participant to deliberately undermine the legitimate operation of the Challenge is a violation of laws and should such an attempt be made, the Organizers reserve the right to seek damages from any such Participant to the fullest extent permitted by law.
33. The Participants may contact [One97] at [games@paytm.com] regarding any queries/complaints pertaining to the Challenge on all working days except public holidays between 9:30 a.m. to 6:30 p.m. All disputes must be addressed by the Participants in writing to [ONE97], and Du shall neither be responsible nor shall entertain any communication in this regard.
34. The Organizers do not make any commitment, express or implied to respond to any feedback, suggestion and/or queries of the Participants.
35. The provisions of this Challenge and any other promotional endeavor may not be used for any commercial purpose by any Participant.
36. These Terms and Conditions are subject to laws of Emirate of Dubai and the federal Laws of the United Arab Emirates applicable in the Emirate of Dubai.
37. Any dispute or matter arising here will be referred to Arbitration to be held in Dubai and conducted in English by three arbitrators pursuant to Dubai International Arbitration Centre.
