PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE REGISTERING TO PARTICIPATE IN THIS CHALLENGE KNOWN AS “IDEA SUPER CHALLENGE SEASON 12”. BY PROCEEDING WITH REGISTRATION AND PARTICIPATING IN THE IDEA SUPER CHALLENGE SEASON 12, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS & CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS & CONDITIONS, PLEASE DO NOT PARTICIPATE IN THE IDEA SUPER CHALLENGE SEASON 12.

Terms and Conditions:

The IDEA SUPER CHALLENGE SEASON 12 (Hereinafter referred to as “Challenge”) is sponsored, organized and administered by One97 Communications Ltd, a company having its registered office at 1^st Floor , Devika Tower, Nehru Place, New Delhi - 110019 and corporate office at B-121, Sector 5, Noida, UP 201301 (hereinafter referred to as “One97”) in association with Idea Cellular Limited, a company having its registered office at Suman Tower, Plot No. 18, Sector – 11, Gandhinagar – 382 011 and Corporate Office at 5th Floor, Windsor, Off CST Road, Kalina, Santacruz (E), Mumbai-400098 (hereinafter referred to as ‘Idea’) (One97 and Idea shall be jointly referred to as ‘Organizer’)and the Challenge is open for a limited period from 15^th July 2016 till 12^th Oct 2016 for pre-paid as well as post-paid category Subscribers^1&2 of Idea for the following telecom Circles.

1.  An active Subscriber shall mean the Subscriber who uses the Subscriber Identity Module (“SIM”) on a regular basis for purposes other than to participate in this Challenge or any other challenges offered by the Organizer jointly.

2. Subscriber shall mean the rightful user of the Idea connection; pre-paid or post-paid, in whose name the mobile phone number (MSISDN) is registered with the operator. In the event the number / connection is registered in the name of a company or firm, the employee who is authorized to use the MSISDN shall submit a No Objection Certificate and authorization of the employer duly permitting the employee to use the MSISDN for participation in the Challenge, receive the gratifications and accept the terms applicable for the Challenge.

• For the avoidance of any doubt, please note that the gratifications offered under this Challenge are solely sponsored and distributed by One97 for the Highest scorers (defined later) of this Challenge and Idea is only providing information and data in relation to the active Subscribers participating in this Challenge and the Short Message Service Centre (“SMSC”) to facilitate the Challenge to be participated by the active Subscribers.
• The Challenge is not available to the Subscribers who are roaming outside their home Circles.
• The Challenge will be available in below mentioned regional languages on SMS and on IVR: 
  • Hindi/ English/ Punjabi/ Gujarati/ Marathi/ Tamil/ Telugu/ Malayalam/ Kannada/ Bengali/ Assamese and Oriya.
• A Subscriber, by participating in the Challenge, hereby agrees to the Terms and Conditions mentioned below and gives his/her irrevocable consent to the process of selecting the highest scorers as set out herein, and any appropriate changes that may be made to this Challenge by the Organizer, including due to any legal or regulatory requirement, instructions from any judicial or a quasi-judicial body or due to any natural calamity beyond the reasonable control of the Organizer, its affiliates and associates or for any other reason whatsoever.
• For the purposes of these Terms and Conditions, wherever the context so requires “You” or “Your” shall mean any natural person who is a Subscriber.

These Terms and Conditions are available on the website at the following address: http://one97.com/contest/idea (“Website”). The Terms and Conditions can be amended or varied from time to time or withdrawn and therefore, please visit the Website periodically to keep yourself updated and informed.

By participating in the Challenge, You indicate Your acknowledgement and acceptance of these Terms and Conditions.

Also, by participating in this Challenge, You:

• Warrant that You have read understood and agreed to conform to these Terms and Conditions. 
• Warrant the accuracy, truthfulness and currency of all information that You have submitted. 
• Agree that You are entering into this Challenge as an independent party and nothing herein establishes an employer-employee relationship between You and Organizer (Idea and One97) and You are acting voluntarily, using Your own time and resources to participate in the Challenge, solely at Your own risk. 
• Warrant that prior to participating in the Challenge, it shall be deemed that You have read and have agreed to be bound by the Terms and Conditions herein.

Unconditional Approval/Acceptance:

• The Subscriber is aware that SMS sent by the Subscriber may not be received by Organizer instantly due to various factors outside the control of the Organizer such as Network failure, system failure, etc. Further The Subscriber undertakes not to dispute/challenge the delay caused in receiving the SMS by Organiser due to such reasons.
• The time at which the Subscriber sends answer from his/her handset will not be considered even if it is earlier. (Example – Subscriber sent answer at 2 pm but it was received by Organizer only at 3 pm. Organizer will consider the time as 3 pm only).
• The Subscriber undertakes not to challenge the selection process of highest scorer(s) in case of tie in the number of points scored, since the time at which the SMS was received by Organizer will be considered for selecting the highest scorer.

1.  Procedure and Eligibility to participate:

This Challenge is valid for all active prepaid and post-paid Subscribers who fulfil the following criteria at the time of participation and during continuation of the Challenge:

• He/she must be of or above 18 years of age at the time of participation in the competition. 
• He/she must be a Citizen of India; 
• He/she must not have been either convicted and / or prosecuted for commission of any criminal offence nor be of an unsound mind; 
• He/she must belong to any of the Circles mentioned above; and 
• He/she must not be under any legal disability e.g. insolvency, restraint by court orders etc. and / or is prohibited from entering any contractual relationship.

Further, the Subscribers who participate in the Challenge and are chosen as highest scorers of each category of gratification under the Challenge in accordance with the highest scorer selection process under the Terms and Conditions of the Challenge, shall be required to be the registered Subscribers of the mobile phone number chosen as the Highest scorer and not merely the persons using such mobile number. Further if employee using mobile number of Company with permission then he has to submit authorization letter of employer for confirmation and If the highest scorer is not able to provide sufficient evidence to show that he/she is the Subscriber of the mobile number, the Organizer reserve the right to forfeit the gratification, at its sole discretion.

2.  Charging: To participate in/register for the Challenge, the Participants have to:

• Register/Subscribe for the Challenge: Registration/Subscription/Participation in the Challenge is free and there are no charges for the same, However for using services (SMS and voice calling) the Subscriber/Registered user shall be charged Rs. 2/- per   answer via SMS or voice calling while answering the question. Registered participant will be able to play a maximum of 900 questions during total challenge period.

• To participate on Voice, the Idea Subscribers have to call 53111, which will be Toll free. To participate through SMS, Subscribers need to send an SMS CAR to 53111 which will be Toll free. This Challenge will be available only in the above mentioned 22 Circles of Idea. Modes of registration/subscription can be added or suspended (due to unavoidable issues on which Organizer does not have any control) during the duration of challenge.

• The charged amount will not be refunded to Subscribers under any circumstances.
• In case of a low balance response for any question, charging will stop - Charging will resume when user initiates again by answering a question through any channel i.e. either on SMS or Voice.

3.  Challenge on Voice:

• The Challenge will be available on 53111 which will be Toll free for all the Subscribers of the above mentioned Circles of Idea. However, the charges to participate on Challenge shall apply as referred in Clause 2 – Charging.
• The participants can press 1 or 2 on the phone keypad to answer the questions of the Challenge.
• For every right answer the participant will get 10 points. There is no negative marking for a wrong answer.
• For every right answer the participant will get 20 point in Happy Hours (as mentioned below). There is no negative marking for a wrong answer. 
• The participant will answer the questions one after the other.
• Subscribers will be informed about the participation charges for the Challenge, gratification and Terms and Conditions URL, when they call the number 53111 Toll-free to participate in the Challenge. 
• After every answer, the Subscriber will be given an appropriate response followed by the updated score and given the next question and answer options. 
• System will continue giving questions one after the other, while the charging happens. However happening of such charging may not necessarily be simultaneous to the question attempted and can also be charged at a later stage i.e. post answering of the question. 
• If the Subscriber stops participating in the Challenge after answering the nth question then when he/she calls on the number 53111 again or sends  as an SMS PLAY to 53111 he/she will be given the (n+1)th question.
• If Subscriber stops participating in the Challenge without answering the nth question, then when he/she calls the afore-mentioned number, he/she will be given the nth question, which may be different from what he/she received previously, i.e., if a Subscriber listens to the 4th questions but drops the call without answering the 4th question, then when he/she calls again, he/she will be given the 4th question, which may be different from what he/she received previously. 
• The Subscribers are given the questions one after the other till he/she finishes answering all the questions of the Challenge. 
• The Subscribers may discontinue participating in the Challenge anytime by sending ‘STOP’ an SMS to 53111.
• Time calculation will start after the every Question play and will end till the user answers the question by pressing relevant key option.

4.  Challenge on SMS:

• The Challenge will be available on the Toll free Short code 53111.
• To participate in the Challenge, Subscribers can send the keyword CAR to toll free Short Code 53111.
• Subscribers may participate in the Challenge by sending the keyword PLAY to 53111 as an SMS to receive a question and answer options and then sending a response to 53111 by typing ‘A’ or ‘B’ for every right answer the participant will get 10 point. There is no negative marking for a wrong answer. 
• For every right answer the participant will get 20 point in Happy Hours (as mentioned below). There is no negative marking for a wrong answer. 
• The participant will answer the questions one after the other.
• For all Subscribers who participate in the Challenge for the first time by sending the keyword CAR as an SMS to 53111, a welcome SMS will be sent to the number of the Subscribers.
• After every answer, the Subscriber will be sent an appropriate response, with the updated score and given the next question and answer options. 
• If a participant doesn’t reply any question within 30 minutes then the question will get expired and no charging will be done.
• If a Subscriber stops participating in the Challenge after answering the nth question then when he/she sends an SMS typing PLAY to the number 53111, he/she will receive the (n+1)th question. If the Subscriber stops participating after answering the nth question then he/she can continue participating by sending PLAY as an SMS to 53111, to receive the next question. 
• If a Subscriber does not receive the subsequent question after answering the nth question, then he/she can continue participating in the Challenge either by sending SMS PLAY to 53111, or calling 53111, during the Challenge, to receive the next question. 
• The Subscriber will be given the questions one after the other on sending PLAY every time as well on answering to the question till he/she finishes answering all the questions of the Challenge. 
• The Subscribers may discontinue participating the Challenge anytime by sending ‘STOP’ an SMS to 53111
• Once the participant pulls the question, timer will start until the participant answers the question. Time will only be recorded if participant answers the question correct or wrong.  

Note: If a participant participates in the Challenge over both the channels (Voice & SMS), his/her score will only be cumulative and not exclusive for each of the channels. i.e.: if the participant has started participating the Challenge on voice and has scored 2 points in 3 questions, if he/she drops the call and resumes participating through SMS, he/she will be given the 4th question, and if he/she answers the question correctly, his/her score will be 3. And this will be the score that will be considered for the highest scorer selection for all the Gratifications.

• Happy Hours – Every day from start of the Challenge till the last day of Challenge, there will be happy hours decided by the Organizer. Subscribers participating in Challenge during happy hours will get 20 points for every right answer. Information regarding happy hours will be sent to all registered users/Subscribers each day by SMS in advance. Participants can also get happy hour information on IVR in Help menu.
• Gratifications and highest scorer selection: 

The selection of the highest scorer shall take place after completion of the Challenge & the gratification shall be distributed thereafter. Highest scorer selection shall be done based on the following criteria:

• Highest Score
• Minimum attempts
• Minimum time taken
• In case there is tie between users - then tie breaker round will be conducted - In case of a tie in the time taken, the participants who have tied will be asked to answer a set of 5 tie breaker questions on IVR. The participant who answers the maximum questions correctly in the given time or in case both the participants answer equal number of questions with equal score then the participant who answers the maximum questions correctly in the least time, will be selected as the highest scorer.

The participant would be declared as highest scorer by an Independent External Auditor appointed by One97.

Post selection of highest scorers the results will be uploaded on link http://one97.com/contest/idea. The highest scorer will have to claim gratification & submit documents (required documents mentioned below) within 30 days from the time One97 uploads the results on the website. It is the responsibility of participants to check the result link provided on a daily basis post completion of Challenge to know the highest scorer and to claim their gratification, if any.

The details required for claiming the gratification shall be mentioned along with the highest scorer list.

One97 shall also make five (5) attempts to contact highest scorers over call to inform about the gratification and further process of claiming the gratification.

The gratification will be forfeited and the highest scorer agrees to surrender the gratification if:

• The highest scorer does not claim the gratification and / or fails to submit all necessary documents within 30 days from the announced results.
• The highest scorer does not submit TDS (if applicable) amount within 20 days of receipt of information from One97.

Post completing documentation process highest scorer will be informed (through telecalling) regarding the modalities of the gratification and distribution thereof. Delivery of gratification will be subject to the Highest Scorers giving the correct address and his/her availability there. All decisions by the Organizer regarding the selection of the Highest Scorers shall be final and binding. In the event the gratification cannot be delivered, within stipulated time period due to reasons beyond the control of One97, the Highest Scorers shall collect them from the nearest place specified by One97 at his own cost. Organizer will not be liable to reimburse the cost so incurred by highest scorer whether travel, accommodation or any cost.

The Organizer reserves the right to forfeit the gratifications under the following circumstances:

• If documents as mentioned in clause 25 are not submitted within 30 days
• If TDS (if applicable) not submitted within 20 days.
• If documents provided are found to be inaccurate/misleading.
• If highest scorer is unwilling to claim/accept the gratification.
• If the highest scorer is not reachable over phone after trying 5 times and not responding to speed post within specified time.
• If the highest scorer is not able to provide sufficient evidence to show that he/she is the Subscriber of the mobile number. Any failure on the part of the highest scorer to comply with directions issued by the Organizer for claim of gratification shall entitle the Organizer to forfeit the gratification(s).

The gratifications shall be as under:

*In case of increase in the value of gratification over and above what has been mentioned above, the incremental difference shall be borne by the highest scorer.

*for all the mentioned gratifications (car, bike etc), the brand, model, colour etc will be decided by One97 at their sole discretion.

SURPRISE DAY Gratification

No. of Gratifications: 15 Mobile Phone (MRP Upto Rs 6000 each) (1 per Week)

Every week there will be one surprise day in challenge. Information regarding surprise day will be available to participants a day prior as well as on surprise day via IVR & SMS. A participant will be eligible for surprise day gratification only once during the entire challenge period.

Number of surprise day per week may vary during the challenge period.

Organisers will not be held responsible if user is not able to use the coupon due to any reason such as non availability of internet connection.
• Paytm codes as assured gratification for registered subscriber can be redeemed only once during the challenge period.
• Paytm Coupon code is valid for only Challenge period.

• Highest scorers (including spouse of highest scorers and immediate/first blood relatives of highest scorers) of previous challenges or engagement activities/offers organized by Organiser across operators who have won a Bumper / First / Grand Gratification shall not be eligible for the Grand Gratification under this challenge. Here engagement activities/offers mean the activities organized by Organiser since 1^st January 2016 with various operators. Highest scorers agree to provide an undertaking to the effect that His/her spouse or immediate/first blood relatives of highest scorers are not the highest scorers of Bumper / First / Grand Gratification of previous challenges and engagement activities/offers organized by Organiser across any operator.
• If any participant has won Bumper / Grand / First Gratification in any previous challenge/engagement activities across all operators then he/she will not be eligible for Bumper & Regional gratification.
• If any participant has won Circle Hub / Circle Zone / Monthly Gratification in any previous challenges of Idea organized by One97 then he/she will not be entitled for Regional Gratification in this challenge.
• Highest scorer, who is found to have made a false claim under sub clause (A) supra, does hereby agree to: 

• Allow Organizer to recover the Gratification (referred in sub-clause (A) supra); and
• Completely indemnify Organizer, including any cost thereof, if declaration made in sub clause (A) supra is found false or incorrect.   

• If the same person having different MSISDN has been selected more than once, in such event he /she will be awarded only one gratification. A Subscriber will be entitled to gratification only once during the entire challenge period. If a Subscriber is declared as highest scorer in more than one category across Bumper, Regional, Circle, & Surprise Day   then he/she shall be entitled to only one highest gratification amongst different gratifications across bumper, Regional, Circle & Surprise Day .This restriction shall not apply to daily recharge & assured gratification but one MSISDN (mobile / cell number) shall only win 1 (one) daily recharge & 1 assured gratification during the entire challenge period.
• One97 does not make any commitment, express or implied to respond to any feedback, suggestion and/or queries of the participants.
• The gratifications offered in this Challenge will be sponsored and distributed by One97 or by a designated third party.
• All gratifications will be given after deducting various taxes, license fees and charges as applicable. The highest scorer has to submit advance Demand Draft of TDS amount of the gratification in favour of “One97 Communications Ltd”
• To be eligible to claim the gratification/s under the Challenge, the MSISDNs chosen as the highest scorers shall be required to be active Subscribers of Idea (who are using SIM on regular basis for purposes other than to participate in this Challenge) during highest scorer announcement period. 
• Without prejudice to the foregoing Clause, any failure on the part of the highest scorer under this Challenge to comply with directions issued by One97 shall entitle One97, at its discretion, to cancel and forfeit the gratification for the said highest scorer. The gratification shall be distributed only after and subject to confirmation of an existing Permanent Account Number (“PAN”) of the highest scorer(s). The Organizer shall not be responsible for any delay on part of a third party including the courier agency, in delivering the gratification. All costs and expenses for collecting the gratification unless otherwise specified shall be borne solely by the highest scorer under this Challenge and the gratification shall not be transferable and no request shall be entertained by the Organizer for such transfer.
• Without prejudice to the foregoing, under no circumstance shall the highest scorers of the Challenge be entitled to redeem any category of gratification for cash, unless expressly mentioned herein. One 97, at its sole discretion, may or may not provide a cash alternative (to any of the gratification being offered in this Challenge. 
• The gratifications offered in this Challenge are subject to availability. Organizer reserves the right, at its sole discretion, to provide alternate gratification of the same value or of any lesser value nearest to original value, for any of the gratification/s under different categories mentioned in the T&C. Also, no request upgrading any gratification offered shall be entertained by the Organizer or Idea. Model or brand or colour for alternate gratification will be decided by One97 at its sole discretion, any choice of highest scorer in respect to Model or brand or colour will not be consider in any case.
• This Challenge is skill based is being made purely on a “best effort” basis and participation of eligible Subscribers is voluntary, and subject to the applicable terms and conditions. 
• By entering the Challenge, You confirm and waive the applicability of rules and regulations of the National Do Not Call Registry and You agree to receive promotional messages and alerts including without limitation daily updates on the score under this Challenge from the Organizer, as they may in their sole and absolute discretion decide.
• Subscribers may contact One97 at games@one97.com regarding any queries/complaints pertaining to the Challenge between 9.30 AM to 6.30 PM on working days from Monday to Friday. All disputes must be addressed by the Subscribers in writing to One 97, and Idea shall neither be responsible nor shall entertain any communication in this regard. Further, any information that the Participant may request in connection with the Challenge, may be provided by the Organizer’ to the Participant, at the sole and absolute discretion of the Organizer’, depending on the nature of the information requested, and any such information may be provided only during a period of 60 days from the end of the Challenge. No such request shall be entertained thereafter.  The Organizer’ further clarify that any information requested by any Participant shall only concern that Participant and under no circumstances will the Organizer provide confidential information or information pertaining to other Participant(s).
• Mere participation in the Challenge shall not entitle a Subscriber to the gratification. No other person or agent can claim the gratification on behalf of the Subscriber, unless otherwise expressly mentioned herein. 
• By participating in the Challenge, Subscribers consent to the following information relating to them to be exchanged between Idea, One 97 and their concerned vendors and/or published or otherwise communicated to in any media that the Organizer may deem fit, for the purpose of highest scorer’s announcement: name, mobile phone number, score and/or photograph. Organizer may, at their discretion, choose not to disclose the identity of the selected highest scorers to other Subscribers unless expressly mentioned herein. The Subscribers also consent to the information being shared by One 97 with its affiliates and service providers and to the information being processed and stored in the servers of One 97 or its service providers, inside or outside India. 
• You acknowledge and agree that all copyright and trademarks and all other intellectual property rights in the SMS content, Website and all material or content related to the Challenge shall remain, at all times, owned by the Organizer and/or their respective owners. All material and content contained in this Website is made available for Your personal and non-commercial use only. Any other use of the material/ content on this Website and/ or any information disseminated by SMS or any other means of communication are strictly prohibited.
• The Organizer are neither responsible nor guarantee the quality of the goods or services being offered as gratification nor are they liable for any defect or deficiency of goods or services so obtained/availed, by the Subscribers under this Challenge. The Organizer is also not liable for any defect/deficiency in the gratification(s) so offered or availed, by the Subscribers under this Challenge. The Subscriber further understands that the goods provided as gratification will carry manufacturer’s guarantee and in case of any deficiency in the goods, participant will contact the manufacturer only. The Subscribers shall not have the right to claim any damages, loss or costs from the Organizer for delay in delivery of the gratification(s) on any grounds whatsoever.
• Subject to any applicable law (a) All warranties of any kind whatsoever, whether express or implied, are hereby expressly DISCLAIMED by the Organizer including, but not limited to, meeting of the Subscriber's requirements or aspirations, timeliness, security, the results or reliability of the Challenge, delay in sending or receiving the SMS for participating in the Challenge, delay in time taken or recorded for answering a question under the tie-breaker process, or the delivery, quality, quantity, merchantability, fitness for use or non-infringement in respect of any goods, services, benefits or awards acquired or obtained through the Challenge or any transactions effected through the Challenge; (b) The Subscriber expressly agree that his/her participation in the Challenge offered by the Organizer is at his/her sole risk and is governed by the Terms and Conditions herein; and (c) No advice or information whether by representations, oral, written or pictorial derived from the Website or through the Challenge shall be construed to mean the giving of any warranty of any kind by the Organizer.
• The gratification(s) under this Challenge are neither assignable nor transferable under any circumstance, unless specifically provided hereunder. All the gratifications shall be subject to such other terms and conditions as may be applicable to specific gratification and shall have to be duly complied with by the highest scorer. 
• The gratification(s) to the highest scorer shall be given subject to compliance with all applicable statutory legislations, processes and formalities in connection with the gratification(s) and on production of all such documents/papers as may be required by the Organizer before accepting the delivery of the gratification. Any failure on the part of the highest scorer to comply with directions issued by the Organizer for claim of gratification shall entitle the Organizer to forfeit the gratification(s) or roll the gratification over to the next eligible highest scorer, at their sole discretion. 
• Any Subscriber providing any incorrect information or concealing/withholding any information from the Organizer with an intent to participate and/or be chosen as the highest scorer of the Challenge will automatically be disqualified from participating in it and being chosen as the highest scorer of the different categories of gratification. Such act of providing incorrect information or concealing/withholding any information, including without limitation incorrect declaration of information relating to name, age, identity, address, mobile connection of Idea number, domicile, payment of outstanding amount to Idea or any other information provided by the Subscriber, shall entitle the Organizer to disqualify him/her without any further intimation. 
• A Subscriber shall be considered ineligible if he/she does not conform to the conditions as stipulated in these Terms and Conditions, or cannot provide any of the required documents as stipulated in clause (25) herein below for the purposes of receiving the gratification.
• All gratifications must be claimed by the highest scorers, along with the documents specified herein below within the specified timelines intimated above by the Organizer. The documents required to be submitted along with the claim by the highest scorers include the following (the document list is only inclusive and not exhaustive and can change as per the requirements of law): 

 

• Address proof (Voter ID / Driving License / Passport/electricity bill not older than 3 months /Telephone bill not older than 3 months etc) 
• Authorization letter or NOC - In case number is registered in the name of a company or firm, the employee who is authorized to use the MSISDN shall submit a No Objection Certificate and authorization letter of the employer.
• For Circle Hub Highest scorer - Affidavit that he / she has not won any bumper / first / grand gratification/ in previous competitions organized by One97 across operators. Also that he/she has not won any Circle Hub /Circle Zone/ Monthly gratification in previous Idea Challenges organized by One97.
• For Bumper Highest scorer - Affidavit that he / she (including spouse of highest scorers and immediate/first blood relatives of highest scorers) has not won any bumper / first / grand gratification in previous competitions organized by One97 across any operators. 
• PAN card copy self attached 
• Submission of acknowledgement letter (as per the format that shall be provided by Organizer) on receipt of the Gratification(s)
• DD equal to TDS amount in advance in favour of One97 Communications Ltd. (30% of gratification amount if exceeding Rs 10,000 as per applicable Income tax rules)
• Post paid bill (for post paid user) (additional  document)
• Affidavit declaration for acceptance of gratification (format will be communicated/shared with highest scorer)
• One passport size photo
• Photo Id proof (Aadhar Card / Passport/Voter ID/Driving License etc)

• Letter of compliance with rules and regulations and declarations in the format as may be required by the Organizer or applicable laws. 
• Extra TDS paid by Successful challenger / participant due to change in pricing at the dealer end. TDS certificate will be issued to the Successful challenger/participant that can be used by Successful challenger/participant while filing returns.
• Every successful challenger has to provide his / her photograph and detailed interview while receiving gratification

The Highest scorers’ names will be announced as registered in the system of Idea. The list of the highest scorers of the gratification will be published on the Website http://one97.com/contest/idea/.

• The Subscribers shall indemnify and keep indemnified the Organizer and their officers, directors, employees, customers, affiliates and agents harmless from and against any and all claims, losses, suits, proceedings, action, liabilities, damages, expenses and costs (including attorney’s fees and court costs) which the Organizer may incur, pay or become responsible for as a result of breach or alleged breach of the representations or obligations of the Subscribers under the Terms and Conditions hereunder, any failure by the Subscribers to comply with applicable law and any third party claim in respect of misuse of any information of a third party. The Organizer shall have the right to defend themselves, pursuant to this Clause, at the cost of the Subscribers. The Organizer or their respective affiliates shall not be responsible for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by the highest scorer or any third party, in connection with the Challenge. 
• The Organizer makes no representation of having a business relationship or tie up with any such companies, individuals or any other organization whose products are offered as gratifications in the Challenge. All trade names shall continue to remain owned by their respective owners. 
• All incidental costs, expenses, taxes or levies related to the gratification(s), if any, shall be exclusively borne by the highest scorers, including but not limited to TDS, gift tax (if any), Insurance and any other taxes applicable by the Central, State or Municipal government. To avail and/or use the gratification, highest scorer shall be solely liable for all applicable laws and regulatory and/or statutory compliances. The participant/s Subscriber/s who have won the gratifications (including those participants if any from towns/ villages) have to make their own arrangements for travel, accommodation to claim the gratification; One97 / IDEA is not responsible for the same or any cost of travel and accommodation incurred by any of them
• Any gratification of value in excess of INR 10,000/- in a year*** will attract deduction of tax at source and all taxes to be paid on the gratification/s shall be paid by the highest scorer at the prevailing rate in advance via Demand draft in favour of “One97 Communications Ltd”. Further, all successful highest scorer must furnish a valid Indian PAN Card to claim the gratification amount, or gratification, irrespective of the value of the same, failing which the successful highest scorer’s gratification shall be forfeited, at the sole discretion of the Organizer.
• ***A Successful highest scorer earning gratification in excess of INR 10,000/- in a year in aggregate from all Challenges / offers conducted by One97 as one of the Organizer’ irrespective of the Operator or other Organizer’ will be subject to TDS under the Income Tax Act, 1961. Gratifications given in kind will be handed only upon receipt and subsequent encashment of the applicable TDS amount by way of Demand Draft.
• Apart from the entitlement to the above gratifications, the highest scorer or their legal heirs, successors and representative will have no other rights or claims against the Organizer, unless expressly mentioned herein. 
• The list of highest scorers for the gratifications will be announced after the end of the Challenge and after all the highest scorer selection processes are completed. 
• The Subscribers and Highest scorers hereby irrevocably authorize Idea and its subsidiaries to use the data gathered during and/or after the Challenge in respect of the Subscriber (including Subscriber’s name and photograph etc.) in any of its communications including marketing promotions and advertisements along with or without Idea’s brand.
• The employees of the Organizer and of their group companies, affiliate or associate companies and their relatives/ dependents shall not be eligible to participate in this challenge. If found otherwise, then organizer reserves the right to forfeit the gratification.
• If an employee of Organizer leaves the organization when the challenge is launched or leave during challenge running period / before highest scorer list announcement / after highest scorer’s list is announced, the participants will not be eligible to participate in the challenge.
• The gratification shall be handed over by One 97 on receipt of all the documents from the highest scorer required to process the distribution of the gratification. This Challenge including the gratification cannot be used in conjunction with any alternative offer or promotion of a similar nature. 
• This Challenge is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of the Organizer (“Force Majeure Event”).The Organizer shall not be liable for any delay or adverse effect caused to this Challenge there under as a result of a Force Majeure Event. The Organizer shall intimate the suspension of the Challenge caused as a result of such Force Majeure Event to the Subscribers within reasonable time.
• The Terms and Conditions stated herein shall not override the terms and conditions of the Subscriber Enrolment Form. 
• This  Challenge  is  subject  to  guidelines/  directions  issued  by  the  Department  of Telecommunications (“DoT”), Telecom Regulatory Authority of India (“TRAI”) or any other statutory authority from time to time.
• The decision of the Organizer in respect of all transactions under this Challenge including without limitation the selection of the highest scorers shall be final and binding. 
• Questions and their answers, designed/sourced by the Organizer, are as per their best knowledge and information available public at large and have been collected and framed with reasonable prudence. In case there is any discrepancy or dispute regarding the questions or answers, neither the Organizer nor any third party involved shall have any liability towards any Subscriber. 
• The Organiser shall not be responsible for any claims arising out of any failure(s) which is beyond the reasonable control of the Organiser. Without limiting the generality of the foregoing, the Organiser shall not be responsible for any claims arising out of technical failures before, during or after the completion of the Challenge including but not limited to any technical failures in the mobile connectivity, delay in sending or receiving the SMS for participating in the Challenge, delay in time recorded or taken for answering a question during the tie-breaker process, any action that has been initiated, actioned or completed through his/her mobile phones, failure of servers or the failure to provide the correct score updates or any failures arising out of technical snags or resultant inability of the listener for participation. Organizer shall neither make any alteration in the score/data/records for the challenge played by the subscriber nor grant any point for the right answered question or extra benefit for the right answered question will be granted to subscriber.
• Awarding of the gratification/s shall at all times be subject to the laws of India, in force, including all the tax laws. Highest scorer shall be solely responsible and liable for all costs, expenses, fees, amounts, outgoings, applicable regulatory and statutory duties, surcharges, taxes (including TDS deduction by One97), insurances, transfer fees, registration fees, and all the expenses over ex-showroom price etc. that may be applicable to avail/use the gratification/s by the highest scorer. All incidental costs/taxes/levies/travel/Stay related to the availing/claiming of the gratification(s), shall be exclusively borne by the highest scorer. Further, the winning participants(s) must furnish a valid Indian PAN Card with all the necessary documents as mentioned in the T&C to claim the Gratification/reward, irrespective of its money value, failing which the winning participant’s Gratification/reward, shall be forfeited at the sole discretion of the Organizers. To avail and/or use the gratification, highest scorer shall be solely liable for all applicable regulatory and statutory compliances.
• The Subscribers hereby agree and undertake not to hold the Organizer and/or any of their group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or indirect or remote that they may/might have suffered, sustained or incurred, or claim to suffer, sustain or incur, by way of and /or on account of this Challenge. 
• The Organizer or any of their group entities or affiliates, their respective directors, officers, employees, agents, representatives, shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal loss or injury that may be suffered (including loss of life), by a Subscriber and/or any third party, directly or indirectly, by use or non-use of the gratification offered in this Challenge. 
• Operator/ One97 reserve the right to make any amendment(s) including but not limited to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this challenge or any part thereof including the eligibility criteria, the Terms & Conditions and gratifications at their sole discretion at any time during its validity basis Operator / One97 sole discretion or under the instructions/ suggestion by regulatory authority and/or statutory changes and the same shall be binding on the participant with notice on website and participants agree that it will be considered as sufficient notice to the participants. Participants’ continued use/participation in the challenge shall be considered as the acceptance to the changes so made. You are therefore advised to check this website regularly for any update(s) or amendment(s) made to these Terms and Conditions and/or Challenge.
• The Organizer may use sub-contractors or third party vendors to execute certain tasks associated with this Challenge, without consent from the Subscribers. 
• The highest scorers shall not be entitled to the gratification, in case he/ she fails to clear all outstanding dues payable to Idea and / or is not an active Subscriber of Idea on the date of announcement of the gratification and as on the date of claiming the gratification. 
• The Organizer reserve the right, at any time, to unconditionally disqualify any Subscriber who tampers with or who in any way abuses the process or Terms and Conditions of the Challenge, without giving any prior intimation to the Subscriber. Failure by the Organizer to enforce any of their rights at any stage does not constitute a waiver of those rights. 
• Any attempt by a Subscriber to deliberately undermine the legitimate operation of the Challenge is a violation of laws and should such an attempt be made, the Organizer reserve the right to seek damages from any such Subscriber to the fullest extent permitted by law. 
• The Organizer does not make any commitment, express or implied to respond to any feedback, suggestion and/or queries of the Subscribers. 
• The officials of the Organizer, including their directors, officers, partners, employees, consultants and agents are under no obligation to render any advice or service to any Subscriber in respect of the Challenge.
• The provisions of this service, the Challenge and any other promotional endeavour may not be used for any commercial purpose by any Subscriber. 
• In case of any technical failure or system failure, no point or extra benefit for the right answered question will be granted to subscriber.
• Post highest scorer declaration and completion of their announcement and further process as the case may be if Organizer finds that the declared highest scorers are wrong then organizer reserves the right to declare the correct highest scorers again and cancel the gratification of highest scorers declared earlier. 
• Points obtained in this challenge will be valid for this challenge only & will not be carry forwarded for new challenge.
• In event of the death of the highest scorer, the gratification if any may be awarded by Organisers to the legal heirs/successors of the deceased highest scorer at sole discretion of the Organisers. Organisers shall have the rights to call for such documentary evidence before handing over the gratification to the legal heirs/successors as it deems fit.
• In the event, it is found or come to the knowledge of Organizer that participant and/or highest scorer submitted inaccurate/misleading details/or information as requested by Organizer as per point no. 25 above or in future course of action, Organizer reserve the right to forfeit the gratification handed over to the highest scorer(s) and/or to be handed over to highest scorer(s) and take the required legal action against them.  
• These Terms and Conditions are subject to Indian law and the exclusive jurisdiction of the Courts in Mumbai. 
• Rule Violation: Based on all the above mentioned rules in the TnC if any rule is violated due to any technical reason then no extra benefit will be granted to the participant.
• In case of MNP i.e. participant is moving from one circle to another circle during the Challenge period while keeping the same mobile number, then he/she shall be considered as eligible for that gratification(s) in the Circle where he/she was residing at the end date of Challenge. The gratification to the highest scorer will be done in the circle where he/she was residing at the time of awarding the gratification.
