TERMS AND CONDITIONS ROSHAN QUIZ COMPETITION

PLEASE READ THESE TERMS & CONDITIONS CAREFULLY BEFORE REGISTERING TO PARTICIPATE IN THIS COMPETITION KNOWN AS “ROSHAN QUIZ COMPETITION”. BY PROCEEDING WITH REGISTRATION AND PARTICIPATING IN THE ROSHAN QUIZ COMPETITION, YOU AGREE TO BE LEGALLY BOUND BY THESE TERMS & CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS & CONDITIONS, PLEASE DO NOT PARTICIPATE IN THE ROSHAN QUIZ COMPETITION.

Terms and Conditions:

THE  ROSHAN QUIZ COMPETITION (Hereinafter referred to as “Competition”) is sponsored, organized and administered by One97 Communications Ltd, a company having its registered office at 1st Floor , Devika Tower, Nehru Place, New Delhi - 110019 and corporate office at B-121, Sector 5, Noida, UP 201301 One97(hereinafter referred to as “One97”) in association with ROSHAN TELECOM  DEVELOPMENT  COMPANY AFGHANISTAN Corp. t/a Roshan  having its principal place of business at House No.152, Park Shar-e-now Street, District 4, Kabul Afghanistan (hereinafter referred to as ‘ROSHAN’) (One97 and ROSHAN shall be jointly referred to as ‘Organiser’) and the Competition is open for a limited period from 5th January 2021, 00:00:01 Hours to 4th April 2021, 23:59:59 Hours (AFT – Afghanistan Time) for the pre-paid category of the Subscribers1of ROSHAN in Afghanistan.

1. An active Subscriber shall mean the Subscriber who uses the Subscriber Identity Module (“SIM”) on a regular basis for purposes other than to participate in this Competition or any other competitions offered by the Organiser jointly.

1. Subscriber shall mean the rightful user of the ROSHAN connection; pre-paid or post-paid, in whose name the mobile phone number (MSISDN) is registered with the operator. In the event the number / connection is registered in the name of a company or firm, the employee who is authorized to use the MSISDN shall submit a No Objection Certificate and authorization of the employer duly permitting the employee to use the MSISDN for participation in the Competition, receive the prizes and accept the terms applicable for the Competition.

• For the avoidance of any doubt, please note that the prizes offered under this Competition are solely sponsored and distributed by Roshan for the Winners (defined later) of this Competition and one97 is only providing information and data in relation to the active Subscribers participating in this Competition, one97 is only facilitating the Competition to be participated by the active Subscribers.

• The Competition is not available to the Subscriber who is in roaming outside Afghanistan. Competition will be available in below mentioned regional language on IVR:

• A Subscriber, by participating in the Competition, hereby agrees to the Terms and Conditions mentioned below and gives his/her irrevocable consent to the process of selecting the Winners as set out herein, and any appropriate changes that may be made to this Competition by the Organiser, including due to any legal or regulatory requirement, instructions from any judicial or a quasi-judicial body or due to any natural calamity beyond the reasonable control of the Organiser, its affiliates and associates or for any other reason whatsoever.

 

• For the purposes of these Terms and Conditions, wherever the context so requires “You” or “Your” shall mean any natural person who is a Subscriber.

 

Also, by participating in this Competition, You:

 

• Warrant that You have read understood and agreed to conform to these Terms and Conditions. 

 

• Warrant the accuracy, truthfulness and currency of all information that You have submitted. 

 

• Agree that You are entering into this Competition as an independent party and nothing herein establishes an employer-employee relationship between You and ROSHAN or between You and One97 and You are acting voluntarily, using Your own time and resources to participate in the Competition, solely at Your own risk. 

 

• Warrant that prior to participating in the Competition, it shall be deemed that You have read and have agreed to be bound by the Terms and Conditions herein. 

These Terms and Conditions are available on the website at the following address: 

http://one97.com/contest/roshan/index.html (“Website”). The Terms and Conditions can be amended or varied from time to time or withdrawn and therefore, please visit the Website periodically to keep yourself updated and informed.

 

By participating in the Competition, You indicate Your acknowledgement and acceptance of these Terms and Conditions.

• Unconditional Approval/Acceptance:

The Subscriber is aware that SMS sent by the Subscriber or short code (IVR) dialed by user may not be received by Organiser instantly due to various factors outside the control of the Organiser such as Network failure, system failure, etc.

The time at which the Subscriber sent from his handset will not be considered even if it is earlier. (Example – Subscriber sent answer at 2 pm but it was received by Organiser only at 3 pm. Organiser will consider the time as 3 pm only).

The Subscriber undertakes not to challenge the selection process of Winner(s) in case of tie in the MOU achieved, since the time at which the SMS was received by Organiser will be considered for selecting the Winner.

The Subscriber undertakes not to dispute/challenge the delay caused in receiving the SMS by Organiser due to network failure, system failure, etc., which are beyond the control of Organiser or Roshan.

 

 

• Procedure and Eligibility to participate:

 

 

All subscribers will automatically be eligible to play and win prizes offered in all contest launched as part of the contest Pack, as will be detailed in the terms and conditions of that respective contest. The prizes offered under the contest may vary from one contest to the next. This Competition is valid for all active prepaid Subscribers of ROSHAN Telecom.

 

• He/she must be of or above 18 years of age; 

 

• He/she must be a resident of Afghanistan; 

 

• He/she must not have been either convicted and / or prosecuted for commission of any criminal offence nor be of an unsound mind; 

• He/she must not be under any legal disability e.g. insolvency, restraint by court orders etc. and / or is prohibited from entering any contractual relationship. 

Further, the Subscribers who participate in the Competition and are chosen as winners of each category of prize under the Competition in accordance with the winner selection process under the Terms and Conditions of the Competition, shall be required to be the registered Subscribers of the mobile phone number chosen as the Winner and not merely the persons using such mobile number. If the winner is not able to provide sufficient evidence to show that he/she is the Subscriber of the mobile number, the Organiser reserve the right to forfeit the prize, at its sole discretion.

 

• Competition on IVR:

 

 

• The Challenge is available on IVR on chargeable short code 666 stands for Premium Contest.
• All the subscribers can play the contest by Dialing 666 chargeable short code, Challenge pack member will be charged 10 Afn per minute browsing the IVR.
• Fresh user will get a language option to select from, after selecting the desire language user will be informed about the participation charges for the competition, gratification and Terms and Conditions, when they call the short code 666 to participate in the competition.
• Post welcome prompts, participant will get an unlimited questions playing one after another.
• For those already played the contest and call back to 666 during the contest period, the participant will get welcome back with contest details prompts will be played. 
• All questions will be in multiple choice format and the answer to each must be selected from one of the 2 options only. 
• The participant will get 10 points for every right answer. There is no negative making for the wrong answer. 
• This challenge consist of unlimited questions during the entire contest period.
• The points gained by you on current day will be carried forward to the next day till end of the contest period.

 

• All charging will be done through Cerebro IN.

 

 

• Winner selection Criteria: 

 

 

The selection of the Winner shall take place after completion of the Competition & the prize shall be distributed thereafter. The Winner will be selected on the basis of the below mentioned selection criterion* (in the order mentioned below):

 

 

• Highest Score – The Participant with highest score during the contest period will be the Winner. In case of a tie on the score, the next criteria will apply.

• Minimum Attempts – In case of a tie on the points Scored, the Participant who has taken minimum attempts to reach the score would be the Winner. In case there is a tie on minimum attempts, the next criteria will apply. 

• Minimum Time Taken – In case of tie on minimum attempts taken by the Participant to reach the score, first Participant to reach minimum time taken will be the Winner.

 

* Selection criteria to be applied in contest of a type of gratification applicable for a day/month/week/specific period/entire Challenge period.

 

** Highest score in minimum number of questions with minimum time taken.

*The time taken for answering a question on “Voice” mode, is calculated from the time the Organizer’s system completes the question and till the answer is received by system

1. The Participants who fulfill the selection criteria mentioned herein will be declared as “Highest Scorer/s” of that gratification type. 
2. The process of selection of final winners for all prize categories shall be carried out by Roshan.
3. In case of a tie between participants for all prize categories (other than recharges), one (1) round of tie-breaker will be conducted for all the tied MSISDNs on IVR, where they will be asked ‘x’ number of questions and the scoring will be done basis the selection criteria mentioned above. In case of a further tie, the selection will be conducted by checking the time taken by the MSISDNs to answer x-1, x-2 questions in the tie-breaker. i.e., if the tie-breaker has 35 questions, and there is a tie in this, then the time taken for a MSISDN to answer 35-1=34 questions will be considered. In case of a further tie in this, then the time taken to answer 34-1=33 questions, and so on will be considered.

** In case of a tie between Participants for Recharge prize category, all the participants who have tied will be gratified. There will be no tie breaker for these prize categories.

1. All the probable Winners shall be chosen in accordance with the Winner selection process duly certified by an Independent Internal Auditor appointed by the Organizer and decision of Independent Internal Auditor shall be final and binding on the Participants. 
2. Without prejudice to the foregoing, the Participant shall not hold the Organizer, the Independent Internal Auditor or Roshan liable for the Winner selection process under this Competition.

 

MSISDN’s of the Top 10 users monthly will be given it to Customer Care after following the winner selection criteria. 

Customer Care will make call to the 1st Winner through 333 if not available then contact 

In order to claim the reward, winner needs to provide following information.

• CRI Form
• National ID/Passport with two passport size photos

If customer fails to provide any of the above mentioned two documents, then the winner will be verified by his/her five relatives, if verification gets failed he/she will not be eligible and next winner will be considered.

If winner provides the above documents/verified by his/her five relatives, post legal check and confirmation, customer signs an agreement with Roshan operator and same will be gratified above prizes.

Winners will be informed via 333 short code only.

 

Post selection of Winners the results will be uploaded on mentioned link http://one97.com/contest/roshan/index.html. ROSHAN shall directly inform the respective winners about the information of wining the prize and respective prize shall be given to such selected winners directly by ROSHAN Below are the details of prizes that will be given by roshan to respective winners.One97 does not make any commitment, express or implied to respond to any feedback, suggestion and/or queries of the participants.

1. Without prejudice to the foregoing Clause, any failure on the part of the Winner under this Competition to comply with directions issued by One 97 shall entitle One 97, at its discretion, to cancel and forfeit the prize for the said Winner. 

 

 

• To be eligible to claim the prize/s under the Competition, the MSISDNs chosen as the winners shall be required to be active Subscribers of (ROSHAN Mobile Radio Application during Winner announcement period. 

 

 

 

• Without prejudice to the foregoing, under no circumstance shall the winners of the Competition be entitled to redeem any category of prize for cash, unless expressly mentioned herein. ROSHAN, at its sole discretion, may or may not provide a cash alternative to any of the prize being offered in this Competition. 

 

 

 

• This Competition is skill based is being made purely on a “best effort” basis and participation of eligible Subscribers is voluntary, and subject to the applicable terms and conditions. 

 

 

 

• By entering the Competition, You confirm and waive the applicability of rules and regulations of the National Do Not Call Registry and You agree to receive promotional messages and alerts including without limitation daily updates on the score under this Competition from the Organiser, as they may in their sole and absolute discretion decide.

 

 

 

• Subscribers may contact One97 at games@one97.com regarding any queries/complaints pertaining to the Competition between 9.30 AM to 6.30 PM (Indian Time zone), on working days from Monday to Friday. All disputes must be addressed by the Subscribers in writing to Organiser. Further, any information that the Participant may request in connection with the Competition, may be provided by the Organiser’ to the Participant, at the sole and absolute discretion of the Organiser’, depending on the nature of the information requested, and any such information may be provided only during a period of 60 days from the end of the Competition. No such request shall be entertained thereafter.  The Organiser’ further clarify that any information requested by any Participant shall only concern that Participant and under no circumstances will the Organiser provide confidential information or information pertaining to other Participant(s).

 

 

 

• Mere participation in the Competition shall not entitle a Subscriber to the prize. No other person or agent can claim the prize on behalf of the Subscriber, unless otherwise expressly mentioned herein. 

 

 

 

• By participating in the Competition, Subscribers consent to the following information relating to them to be exchanged between ROSHAN, One 97 and their concerned vendors and/or published or otherwise communicated to in any media that the Organiser may deem fit, for the purpose of winner’s announcement: name, mobile phone number, score and/or photograph. Organiser may, at their discretion, choose not to disclose the identity of the selected winners to other Subscribers unless expressly mentioned herein. The Subscribers also consent to the information being shared by One 97 with its affiliates and service providers and to the information being processed and stored in the servers of One 97 or its service providers, inside or outside India. 

 

 

1. You acknowledge and agree that all copyright and trademarks and all other intellectual property rights in the SMS content, Website and all material or content related to the Competition shall remain, at all times, owned by the Organiser and/or their respective owners. All material and content contained in this Website is made available for Your personal and non-commercial use only. Any other use of the material/ content on this Website and/ or any information disseminated by SMS or any other means of communication are strictly prohibited. The Subscribers shall not have the right to claim any damages, loss or costs from the Organiser for delay in delivery of the gratification(s) on any grounds whatsoever.

 

 

• Subject to any applicable law (a) All warranties of any kind whatsoever, whether express or implied, are hereby expressly DISCLAIMED by the Organiser including, but not limited to, meeting of the Subscriber's requirements or aspirations, timeliness, security, the results or reliability of the Competition, delay in sending or receiving the SMS for participating in the Competition, delay in time taken or recorded for answering a question under the tie-breaker process, or the delivery, quality, quantity, merchantability, fitness for use or non-infringement in respect of any goods, services, benefits or awards acquired or obtained through the Competition or any transactions effected through the Competition; (b) The Subscriber expressly agree that his/her participation in the Competition offered by the Organiser is at his/her sole risk and is governed by the Terms and Conditions herein; and (c) No advice or information whether by representations, oral, written or pictorial derived from the Website or through the Competition shall be construed to mean the giving of any warranty of any kind by the Organiser. 

 

 

 

• The prize(s) under this Competition are neither assignable nor transferable under any circumstance, unless specifically provided hereunder. All the prizes shall be subject to such other terms and conditions as may be applicable to specific prize and shall have to be duly complied with by the winner. 

 

 

 

• The prize(s) to the winner shall be given subject to compliance with all applicable statutory legislations, processes and formalities in connection with the prize(s) and on production of all such documents/papers as may be required by the Organiser before accepting the delivery of the prize. Any failure on the part of the winner to comply with directions issued by the Organiser for claim of prize shall entitle the Organiser to forfeit the prize(s) or roll the prize over to the next eligible winner, at their sole discretion. 

 

 

 

• Any Subscriber providing any incorrect information or concealing/withholding any information from the Organiser with an intent to participate and/or be chosen as the winner of the Competition will automatically be disqualified from participating in it and being chosen as the winner of the different categories of prize. Such act of providing incorrect information or concealing/withholding any information, including without limitation incorrect declaration of information relating to name, age, identity, address, mobile connection of ROSHAN number, domicile, payment of outstanding amount to ROSHAN or any other information provided by the Subscriber, shall entitle the Organiser to disqualify him/her without any further intimation. 

 

 

 

• A Subscriber shall be considered ineligible if he/she does not conform to the conditions as stipulated in these Terms and Conditions, or cannot provide any of the required documents as stipulated in clause  herein below for the purposes of receiving the prize. 

 

 

 

• The Winners’ names will be announced as registered in the system of ROSHAN. 

 

 

 

• The Subscribers shall indemnify and keep indemnified the Organiser and their officers, directors, employees, customers, affiliates and agents harmless from and against any and all claims, losses, suits, proceedings, action, liabilities, damages, expenses and costs (including attorney’s fees and court costs) which the Organiser may incur, pay or become responsible for as a result of breach or alleged breach of the representations or obligations of the Subscribers under the Terms and Conditions hereunder, any failure by the Subscribers to comply with applicable law and any third party claim in respect of misuse of any information of a third party. The Organiser shall have the right to defend themselves, pursuant to this Clause, at the cost of the Subscribers. The Organiser or their respective affiliates shall not be responsible for any direct, indirect, incidental, special, punitive or consequential damages, including loss of profits, incurred by the winner or any third party, in connection with the Competition. 

 

 

 

• The Organiser makes no representation of having a business relationship or tie up with any such companies, individuals or any other organization whose products are offered as prizes in the Competition. All trade names shall continue to remain owned by their respective owners. 

 

 

 

• Apart from the entitlement to the above prizes, the winner or their legal heirs, successors and representative will have no other rights or claims against the Organiser, unless expressly mentioned herein. 

 

 

 

• The list of winners for the prizes will be announced after the end of the Competition and after all the winner selection processes are completed. 

 

 

 

• The Subscribers and Winners hereby irrevocably authorize ROSHAN and its subsidiaries to use the data gathered during and/or after the Competition in respect of the Subscriber (including Subscriber’s name and photograph etc.) in any of its communications including marketing promotions and advertisements along with or without ROSHAN’s brand. 

 

 

1. The employees of the Organiser and of their group companies, affiliate or associate companies and their relatives/ dependents shall not be eligible to participate in this competition. If found, then Organiser reserve the right to forfeit the prize.
   
   If an employee of Organiser leaves the organization when the competition is launched or leave during competition running period / before winner list announcement / after winner’s list is announced, the participants will not be eligible to participate in the competition. 

 

 

• The prize shall be handed over by One 97 on receipt of all the documents from the winner required to process the distribution of the prize. This Competition including the prize cannot be used in conjunction with any alternative offer or promotion of a similar nature. 

 

 

 

• This Competition is subject to force majeure circumstances including without limitation, floods, natural disasters, war, act of terror, political unrests, technical snags, act of God or any circumstance beyond the reasonable control of the Organiser (“Force Majeure Event”).The Organiser shall not be liable for any delay or adverse effect caused to this Competition there under as a result of a Force Majeure Event. The Organiser shall intimate the suspension of the Competition caused as a result of such Force Majeure Event to the Subscribers within reasonable time. 

 

 

 

• The Terms and Conditions stated herein shall not override the terms and conditions of the Subscriber Enrolment Form. 

 

 

 

• The decision of the Organiser in respect of all transactions under this Competition including without limitation the selection of the winners shall be final and binding. 

 

 

 

• Questions and their answers, designed/sourced by the Organiser, are as per their best knowledge and information available and have been collected and framed with reasonable prudence. In case there is any discrepancy or dispute regarding the questions or answers, neither the Organiser nor any third party involved shall have any liability towards any Subscriber. 

 

 

1. The Organiser shall not be responsible for any claims arising out of any failure(s) which is beyond the reasonable control of the Organiser. Without limiting the generality of the foregoing, the Organiser shall not be responsible for any claims arising out of technical failures before, during or after the completion of the Competition including but not limited to any technical failures in the mobile connectivity, delay in sending or receiving the SMS for participating in the Competition, delay in time recorded or taken for answering a question during the tie-breaker process, any action that has been initiated, actioned or completed through his/her mobile phones, failure of servers or the failure to provide the correct minute of usage (MOU) updates or any failures arising out of technical snags or resultant inability of the listener for participation. Organizer shall neither make any alteration in the /data/records for the competition played by the subscriber nor grant any point for the right answered question or extra benefit for the right answered question will be granted to subscriber.

 

 

• The Subscribers hereby agree and undertake not to hold the Organiser and/or any of their group entities or affiliates, their respective directors, officers, employees, agents, vendors, responsible for or liable for, any actions, claims, demands, losses, damages, costs, charges and expenses, either direct or indirect or remote that they may/might have suffered, sustained or incurred, or claim to suffer, sustain or incur, by way of and /or on account of this Competition. 

 

 

 

• The Organiser or any of their group entities or affiliates, their respective directors, officers, employees, agents, representatives, shall not be liable for any loss or damage whatsoever that may be suffered, or for any personal loss or injury that may be suffered (including loss of life), by a Subscriber and/or any third party, directly or indirectly, by use or non-use of the prize offered in this Competition. 

 

 

1. The Organiser reserve the right to make any amendment(s) including but not limited to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this competition or any part thereof including the eligibility criteria, the Terms & Conditions and prizes at their sole discretion at any time during its validity basis Organizer’s sole discretion or under the instructions/ suggestion by regulatory authority and/or statutory changes and the same shall be binding on the participant with notice on website and participants agree that it will be considered as sufficient notice to the participants. Participants’ continued use/participation in the competition shall be considered as the acceptance to the changes so made. You are therefore advised to check this website regularly for any update(s) or amendment(s) made to these Terms and Conditions and/or Competition.

 

 

• The Organiser may use sub-contractors or 3rd party vendors to execute certain tasks associated with this Competition, without consent from the Subscribers. 

 

 

 

• The winners shall not be entitled to the prize, in case he/ she fails to clear all outstanding dues payable to ROSHAN and / or is not an active Subscriber of ROSHAN on the date of announcement of the prize and as on the date of claiming the prize. 

 

 

 

• The Organiser reserve the right, at any time, to unconditionally disqualify any Subscriber who tampers with or who in any way abuses the process or Terms and Conditions of the Competition, without giving any prior intimation to the Subscriber. Failure by the Organiser to enforce any of their rights at any stage does not constitute a waiver of those rights. 

 

 

 

• Any attempt by a Subscriber to deliberately undermine the legitimate operation of the Competition is a violation of laws and should such an attempt be made, the Organiser reserve the right to seek damages from any such Subscriber to the fullest extent permitted by law. 

 

 

 

• The Organiser does not make any commitment, express or implied to respond to any feedback, suggestion and/or queries of the Subscribers. 

 

 

 

• The officials of the Organiser, including their directors, officers, partners, employees, consultants and agents are under no obligation to render any advice or service to any Subscriber in respect of the Competition. 

 

 

 

• The provisions of this service, the Competition and any other promotional endeavor may not be used for any commercial purpose by any Subscriber. 

 

 

1. In case of any technical failure or system failure, no point or extra benefit for the right answered question will be granted to subscriber.

 

1. Post winner declaration and completion of their announcement and further process as the case may be if Organiser finds that the declared winners are wrong then Organiser reserves the right to declare the correct winners again and cancel the prize of winners declared earlier. 

 

1. Rule Violation: Based on all the above mentioned rules in the TnC if any rule is violated due to any technical reason then no extra benefit will be granted to the participant.

 

1. Points obtained in this competition will be valid for this competition only & will not be carry forwarded for new competition.

 

1. In event of the death of the winner, the prize if any may be awarded by Organisers to the legal heirs/successors of the deceased winner at sole desecration of the Organisers. Organisers shall have the rights to call for such documentary evidence before handing over the prize to the legal heirs/successors.

 

1. The Organiser have the right to forfeit the prize under the following circumstances:

• If highest SCORE user is unwilling to claim/accept the gratification.

Any failure on the part of the highest SCORE user to comply with directions/terms and conditions issued by the Organiser for claim of Prize.
