TERMS AND CONDITIONS OF CONTEST

The name of the Contest is Airtel Mega Win Season 11 - New year Bumper Bonanza. The “Contest” is open only to Indian citizens (individuals), residing in India, aged 18 years or above and are valid Airtel Prepaid and/or Postpaid subscribers.

The Contest is organized by Bharti Airtel Ltd. for their subscribers, and managed by One97 Communications Limited having registered office at First Floor, Devika Tower, Nehru Place, New Delhi-110019 and its corporate office at B-121, Sector-5, Noida - 201301, India (hereinafter referred to as “One97”). One97 and Airtel shall be jointly referred to as ‘Organizers’.

For the sake of clarity, a “Subscriber*/s /participant” for the purpose of this Contest shall mean and include an individual/person, who is the rightful owner/user of the pre-paid or post-paid mobile connection of Operator, registered in Airtel telecom circles in and in whose name the mobile connection is active and registered as per the records maintained by Operator  

The Contest shall run for the period of 90 days commencing from  27th Dec, 2016 at 00:00:01 hours in the morning and concluding on 26^th Mar 2017 at 23:59:59 hours in the night (both days inclusive) (hereinafter referred as the “Contest Period”, mentioned in Annexure).

NOTE: subscriber shall mean the rightful user of the Airtel  connection, pre-paid or post-paid, in whose name the mobile phone connection number (MSISDN) is registered with the operator. In the event the  number / connection is registered in the name of a company/ firm, the employee who is authorized to use the connection shall submit a No Objection Certificate (NoC) and authorization of the employer duly permitting the employee to use the number for participation in the Competition, receive the prizes and accept the terms applicable for the Competition. This is not applicable on recharges.

To participate in/register for the Contest, the Subscribers have to:

Register/Subscribe for the Contest:

Registration/Subscription can be done by calling 53111 or by sending SMS WIN to 53111. Subscription will be done for 999 days. Modes of registration/ subscription can be added or suspended (due to unavoidable issues on which Organizer does not have any control) during the duration of the contest.

On subscribing through any of the above mentioned modes, the successful Subscriber will receive an acknowledgement SMS on his/her mobile number registered with Airtel informing him/her about his subscription status.

If a subscribed user wants to unsubscribe from the contest then it can be done by typing ‘STOP’ and sending it as an SMS to 53111 (toll-free) or by calling the toll-free number 53111.

 

 

Charging:

All the subscribers of contest will be charged Rs. 5/-, Rs. 3/- or Rs. 1/- per day (“Daily Charging Amount”), depending on the available balance on his/her MSISDN registered with Airtel.

All subscribed/registered users will be charged from the 1st day of the contest, or the day that he/she subscribes/registers to the contest, till the end of the contest, or till the day he/she unsubscribe from the contest, whichever happens first, irrespective of whether the contest subscribers plays the contest or not. This Daily Charging Amount will not be refunded to subscribe users under any circumstances.

On non-contest days the subscribers will not be charged.

All contest subscribers will be allowed to play the contest each day irrespective of successful charging on each day. If the charging fails for any particular day during the contest, the subscribed user will be allowed to play the contest for that day, however the questions attempted by such subscriber shall not be considered for the Winner selection process for any of the prizes under the contest.

Therefore:

For subscribers that are charged Rs.5 for a day, all 5 questions played shall be considered for the purposes of Winner selection.

For subscribers that are charged Rs.3 for a day, only the first 3 questions played shall be considered for the purposes of Winner selection.

For subscribers that are charged Rs.1 for a day, only the first questions played shall be considered for the purposes of Winner selection.

After playing 5 questions allotted per day, subscribers can further play more questions with a charging of Rs 1 per question.

Total questions in contest:

There will be a total of 1000 questions available to subscribed user to play during the contest period i.e 90 days. Question allotment will be done based on first activation date of user in this contest. For example, if user subscribes on 1st day of contest start, then questions allotted will be [450 (5 per day) + 550 ppq (can be played any day during contest period)]. If user subscribes on 31^st day of contest start, then questions allotted will be [300 (5 per day) + 700 ppq (can be played any day during contest period)] & so on.

User can only play his/her ppq (pay per questions) only after playing the first 5 questions every day.

Questions will not be carried forward i.e. if a user plays 2 questions on Current day & does not play the remaining 3 questions on Current day itself, then those 3 questions will be lapsed.

Note: If due to any network failure / technical failure or any other reason, charging notification is received after 48 hours, then the same will not be considered. Final scores will be updated as per the charging notifications which are received within 48 hrs.

Procedure and Eligibility to participate:

This Contest is valid for all active Prepaid and Postpaid Airtel Subscribers who fulfill the following criteria at the time of participation and during the Contest Period:

Subscriber must be an individual and his/her age should be 18 years or more.

Subscriber must be a citizen of India.

He/she must not have any criminal record (i.e. neither convicted nor prosecuted for commission of any criminal offence) or be of an unsound mind.

He/she must have a firm contractual capacity and is not under any legal disability e.g. insolvency, restraint by court orders etc. and / or is prohibited from entering any contractual relationship.

If the highest scorer is not able to provide sufficient evidence as per the documents listed in  Annexure B to show that he/she is the Subscriber of the mobile number, the Organizers’ reserve the right to forfeit the prize, at their sole discretion. 

The Contest is neither open to employees of Airtel nor of One97. 

The Contest is valid only in India.

The participation in the Contest is purely voluntary.

These Terms and Conditions are available on the website at the following address: http://megawincontest.in. By participating in the Contest, you indicate your acknowledgement and acceptance of these Terms and Conditions.

The Contest is in the form of questions based on general knowledge, which must be answered by the Subscriber by using his knowledge and skill. The questions under this Competition shall be based on information available to the public at large.

To participate on Voice, the Airtel Subscribers have to call 53111, which will be Toll free. To participate through SMS, Subscribers need to send SMS WIN to 53111 which will be Toll free. This Contest will be available only in the above mentioned 23 circles of Airtel.

Contest on Voice:

The Contest will be available on 53111 which will be Toll free for all the Airtel Subscribers of the above mentioned circles of Airtel.

The Subscribers can press 1 or 2 on the phone keypad to answer the questions of the Contest.

For every right answer the Subscriber will get 10 points. There is no negative point for a wrong answer.

Contest on SMS:

The Contest will be available on the Toll free Short code 53111.

To participate in the Contest, Airtel Subscribers can send the keyword WIN to toll free Short Code 53111.

Subscribers can participate in the Contest by sending a response to the question that they have received last. There will be 2 response options in each question out of which 1 option is correct. Subscriber needs to choose the option.

For every right answer, the Subscriber will get 10 points. There is no negative point for a wrong answer. 

After answering one question, user will be given next question along with the correct/wrong response of previous question.

Out of the allotted 5 questions per day, if on current  day user plays 3 questions & does not plays the 4^th question on same day but answers the question on next day, then that question will be considered as 1^st question of the next day.

 Happy Hours: There will be happy hours decided by the Organizers. Subscribers participating in Contest during happy hours will get 20 points for every right answer. Information regarding happy hours will be sent to all registered users/Subscribers via SMS in advance. Subscribers can also get happy hour information on IVR in Help menu.

If a Subscriber participates in the Contest over any of the channels (Voice or SMS), his/her score will only be cumulative and not exclusive for each of the channels. i.e.: if the Subscriber has started participating in the Contest on Voice and has scored 20 points in 2 questions, if he/she drops the call and resumes participation through SMS, he/she will be given the 3^rd question, and if he/she answers the question correctly, his/her score will be 30 and this will be the score that will be considered for the highest score’s selection of all the prizes.

The prizes and its related terms and conditions are mentioned in the Annexure A.

Neither Airtel nor One97 will  be responsible for any loss, damage, claimed/demanded by the Subscribers due to any of the following reasons:

Subscriber is unable to send the SMS for whatever reasons to the Contest short code

Subscriber sends an SMS inadvertently or otherwise to a wrong SMS code;

Subscriber sends the SMS but with wrong text;

Subscriber is unable to understand the terms and conditions of the Contest;

Subscriber is unable to understand the process of participation or is unable to participate in the Contest;

Subscriber is declared as a winner but is aged less than 18 years of age or is incompetent to enter into a contract;

Any other reason, event, error or incidence not within the control of Airtel / One97.

To receive prize, winner should produce proper set of documents as defined  in Annexure B and in absence of that the winner agrees to forego his/her prize.

Airtel / One97 reserve the right to make any amendment(s) including but not limited to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this contest or any part thereof including the eligibility criteria, the Terms & Conditions and gratifications at their sole discretion at any time during its validity basis Airtel / One97 sole discretion or under the instructions/ suggestion by regulatory authority and/or statutory changes and the same shall be binding on the Subscriber with notice on website and Subscribers agree that it will be considered as sufficient notice to the Subscribers. Subscribers’ continued use shall be considered as the acceptance to the changes so made. You are therefore advised to check this website regularly for any update(s) or amendment(s) made to these Terms and Conditions.

The Contest cannot be clubbed with any other contest or offer. 

Airtel and/or One97 shall not be liable for any failure to comply with its obligations contained herein, caused by weather conditions, fire, flood, strike, hurricane, industrial dispute, war, hostilities, political unrest, riots, civil commotion, terrorist attack, inevitable accidents, acts of god or any other circumstances amounting to Force Majeure. 

Airtel and/or One97 shall not be responsible for any loss or damage if it has to discontinue or cancel this Contest in compliance with any law, ruling, order, regulation, circular, notification, requirement or instruction of any Central/State Government or for any other unavoidable reason beyond its control. The Subscribers shall be informed of such discontinuance/cancellation as soon as possible, through SMS.

The participation in this Contest implies unconditional acceptance of all the terms and conditions of the Contest by the Subscribers.

The decision of One97 as to the interpretation of any of these terms and conditions shall be final and binding on the Subscribers.

Neither Airtel nor One97 shall be responsible if the Subscriber is unable to participate in the Contest due to network failure, network congestion, network unavailability or any such technical issues faced by the Subscriber.

The Subscriber hereby understands and gives his/ her irrevocable consent for personal information relating to the subscriber to be exchanged with or published and/or communicated to/in any media that it may deem fit, and or their vendors may, at its sole discretion choose to publish or disclose the name(s), phone number(s), score(s) and/or photographs of Subscribers, if required, and specifically, of winners for the purpose of media coverage and alike activities.

Subscriber can send an email to gamesHYPERLINK "mailto:@one97.com"@one97.net and all their queries shall be answered within a TAT of 48 hours in working days. All disputes must be addressed by the Subscriber in writing to One97 directly and Airtel shall not entertain any communication in this regard. Further, any information that the Subscriber may request in connection with the Contest, may be provided by One97’ to the Subscriber, at the sole and absolute discretion of the  One97 ’, depending on the nature of the information requested, and any such information may be provided only during a period of 30 days from the end of the Contest. No such request shall be entertained thereafter.  The One97’ further clarify that any information requested by any Subscriber shall only concern that Subscriber and under no circumstances will the One97’ provide confidential information or information pertaining to other Subscriber(s).

Airtel or One97 shall not be responsible for any claims arising out of any failure(s) which is beyond the reasonable control of the One97 or Airtel. Without limiting the generality of the foregoing, the One97 Or Airtel shall not be responsible for any claims arising out of technical failures before, during or after the completion of the contest including but not limited to any technical failures in the mobile connectivity, delay in sending or receiving the SMS for participating in the contest, delay in time recorded or taken for answering a question during the tie-breaker process, any action that has been initiated, actioned or completed through his/her mobile phones, failure of servers or the failure to provide the correct score updates or any failures arising out of technical snags or resultant inability of the listener for participation. One97 or Airtel shall neither make any alteration in the score/data/records for the contest played by the subscriber nor  extra benefit for the right answered question will be granted to Subscriber.

Upon participating in the Contest, the Subscriber confirms and waives the applicability of rules and regulations of the National Do Not Call Registry and shall imply their willingness to receive all communications related to contest. They can at any given point of time deactivate from the contest.

Organizer or Airtel shall not be responsible for any SMS message delivery failures, for any lost, late or misdirected network, electronic failures of any kind or any failure to receive entries owing to transmission failures or due to any technical reasons and/or other conditions beyond its reasonable control.

Rule Violation: Based on all the mentioned rules in the T&C if any rule is violated due to any technical reason then no extra benefit will be granted to the Subscriber.

Points obtained in this contest will be valid for this contest only & will not be carried forward to any new contest.

Unconditional Approval/Acceptance:

The Subscriber is aware that SMS sent by the Subscriber may not be received by Organizer instantly due to various factors outside the control of the Organizer such as Network failure, system failure, etc.

The time at which the relevant message is received by the Organizer shall be only considered for the purpose of this contest. The time at which the Subscriber sent the message from his handset will not be considered even if it is earlier. (Example – Subscriber sent answer at 2 pm but it was received by Organizer only at 3 pm. Organizer will consider the time as 3 pm only).

The Subscriber undertakes not to challenge the selection process of winner(s) in case of tie in the number of points scored, since the time at which the SMS was received by Organizer will be considered for selecting the winner.

The Subscriber undertakes not to dispute/challenge the delay caused in receiving the SMS by Organizer due to network failure, system failure, etc., which are beyond the control of Organizer or Airtel.

Annexure B

Winner Selection & Declaration

The selection of the winner of the Competition, shall take place after completion of the Competition. Winner selection is done based on following criteria:

In case there is tie between the users, then tie breaker round will be conducted - In case of a tie, the Subscribers who have tied will be asked to answer a set of 5 tie breaker questions, the Subscriber who answers the maximum questions correctly in the given time or in case both the Subscribers answer equal number of questions the Subscriber who answers the maximum questions correctly in the least time, will be selected as the winner.

The process of Winner selection for each category of prize, in accordance with the Winner selection process detailed in this Competition, will be witnessed by Independent External Auditor appointed by the Organizer (“Independent Auditor”) who shall certify the Winners. The decision of Independent External Auditor shall be final and binding on the Subscribers.

All decisions of Organizer in respect of all transactions under this Competition, including without limitation the selection of Winners as certified by the Independent Auditor and other related transactions shall be final and binding and no correspondence or communication shall be entertained in this regard.

Winners (including spouse of winners and immediate/first blood relatives of winners) of previous contests organized by Organizer across Operators who have won a Bumper / First / Grand Prize shall not be eligible for the Bumper  Prize under this contest and winners agree to provide an undertaking to the effect that - His/her spouse or immediate/first blood relatives of winners are not the winners of Bumper / First / Grand Prize of previous contests organized by Organizer across any operator. 

Winner, who is found to have made a false claim under sub clause (5) of Annexure B supra, does hereby agree to: 

Allow Organizer to recover the Prize (referred in sub-clause (5) supra); and

Completely indemnify Organizer, including any cost thereof, if declaration made in sub clause (5) supra is found false or incorrect

A Subscriber will be entitled to win only once during the entire Contest Period. If the same person having different MSISDN (mobile/cell number) has been selected more than once, in such event he /she will be awarded only one Prize. If a Subscriber is declared as winner in more than one category across Bumper, Circle & Special occasion, then he/she shall be entitled for only one prize of highest value. This restriction shall not apply to Daily prize prize, but one mobile number (mobile/cell number) shall only win 1 Daily  during the entire contest period.

Post selection of winners the results will be uploaded on mentioned link HYPERLINK "http://megawincontest.in"http://megawincontest.in. 

Recharge prize - For pre paid customers the amount shall be added to their recharge amount; for post paid customers, the amount shall be credited to their respective accounts in relevant payment cycle. Post recharge, winners shall be informed about their recharge via SMS.

Prize Distribution, statutory obligations & forfeiting the prize:

One97 shall make 5 consecutive attempts to contact Winners over phone call to inform about the prize and further process of claiming the prize. The winner shall be eligible to claim the prize by submitting the documents (required documents mentioned below) within 30 days after One97 uploads the results on website. It is the responsibility of Subscribers to check the result link provided on daily basis, post completion of contest to know the winners. And further it is the responsibility of winners to claim their prize. The details required for claiming the prize shall be mentioned along with winner list.

 

Any gratification of value in excess of INR 10,000/- in a year*** will attract deduction of tax at source and all taxes to be paid on the gratification/s shall be paid by the highest scorer at the prevailing rate in advance via Demand draft in favour of “One97 Communications Ltd”. One97 will inform the TDS amount in advance to Winner. The Winner will receive a TDS certificate in respect of the amount of TDS as per arrangement in Income Tax Act 1961.

 

***A Successful highest scorer earning gratification in excess of INR 10,000/- in a year in aggregate from all Challenges / contest conducted by One97 as one of the Organizer’ irrespective of the Operator or other Organizer’ will be subject to TDS under the Income Tax Act, 1961. Gratifications given in kind will be handed only upon receipt and subsequent encashment of the applicable TDS amount by way of Demand Draft.

 

All prizes must be claimed by the Winners, along with the documents specified herein below within the specified timelines intimated by the Organizer. The documents required to be submitted along with the claim by the Winners include the following:

Required documents:

Address proof (Voter ID / Driving License / Passport/electricity bill not older than 3 months /Telephone bill not older than 3 months etc) – the address should be the same as mentioned in the operator records.

Photo Id proof (Aadhar Card / Passport/Voter ID/Driving License etc) – the name on the id proof should be the same as mentioned in the operator records.

One passport size photo

Affidavit declaration for acceptance of prize (format will be communicated/shared with winner)

Post paid bill (for post paid user) (additional  document)

Demand Draft (DD) equal to TDS amount in advance in favor of One97 Communications Ltd as per the  applicable provision of  Income Tax  Act 1961)

Submission of acknowledgement letter (as per the format that shall be provided by Organizer) on receipt of the Prize(s)

PAN card copy self attached 

For Bumper winner & circle /special occasion  winner - Affidavit mentioning that he / she (including spouse of winners and immediate/first blood relatives of winners) has not won any bumper / circle /special occasion in the previous contests organized by One97 across operators.

Authorization letter or NOC -In case number is registered in the name of a company or firm, the employee who is authorized to use the MSISDN shall submit a No Objection Certificate and authorization of the employer .

The Organizer reserves the right to forfeit the prizes under the following circumstances:

The winner does not claim the prize & or fails to submit all necessary documents within 30 days after One97 uploads the results on the website;

The winner does not submit TDS (if applicable) amount within 10 days of receipt of information from One97

If documents provided are found to be inaccurate/ misleading.

If winner is unwilling to claim/ accept the prize.

If the win ner is not reachable over phone after trying 5 times.

If the winner is not able to provide sufficient evidence (id and address proof) to show that he/she is the Subscriber of the mobile number (MSISDN).

Any failure on the part of the winner to comply with directions issued by the One97 for claim of prize shall entitle the One97 to forfeit the prize(s), at their sole discretion.

The Winners’ names will be announced as registered in the system of Airtel.

Post completing the documentation process, winner will be informed (through tele calling) regarding the modalities of the prize and distribution thereof.

Delivery of prize will be subject to the Winners giving the correct address and his/her availability there. In the event the prize cannot be delivered, within stipulated period, due to reasons beyond the control of One97, the Winners shall  collect them from the nearest place specified by One97 at his own cost. One97 or Airtel will not be liable to reimburse the cost so incurred by winner whether travel, accommodation or any cost.

The prize/s shall be subject to the laws of India, including all the tax laws. All applicable regulatory and statutory duties, surcharges, taxes (including TDS deduction by One97), insurances, transfer fees, registration fees etc. that may be applicable to avail/use the prize/s will be borne by the winner. All incidental costs/taxes/levies/travel/Stay related to the prize(s), shall be exclusively borne by the winner. Further, all the winning Subscribers(s) must furnish a valid Indian PAN Card copy to claim the Prize/reward amount, or Prize/reward, irrespective of the value of the same, failing which the winning Subscriber’s Prize/reward shall be forfeited at the sole discretion of the Organizers.

The prize(s) to the Winners shall be given subject to compliance with all applicable statutory legislations, processes or formalities in connection with the prize(s) and on production of all such documents/papers as may be required by the Organizer before accepting the delivery of the prize. Any failure on the part of the Winners to comply with directions issued by the Organizer for claim of prize shall entitle the Organizer to forfeit the prize(s) or the prize shall be rolled over to the next eligible Subscriber, at the sole discretion of the Organizer.

The prizes shall be handed over by One97 on receipt of all the documents, from the Winners, required to process the distribution of the prize.

In event of the death of the winner, the prize if any may be awarded by One97 to the legal heirs/successors of the deceased winner at sole discretion of the Organisers. Organisers shall have the rights to call for such documentary evidence before handing over the prize to the legal heirs/successors.

Apart from the entitlement to the prize/s in this contest, the winner/s (as declared by One97) or their legal heirs will have no other rights or claims against One97 or Airtel.

In the event, it is found or comes to the knowledge of One97 or Airtel that Subscriber and/or winner has submitted inaccurate/ misleading details or information as requested by Organizer as per required document section mentioned above or in future course of action, Organizer reserve the right to forfeit the prize handed over to the winner(s) and/or to be handed over to winner(s) and take the required legal action against them.

In case of MNP i.e. Subscriber is moving from one circle to another circle during the contest period while keeping the same mobile number, then he/she shall be considered as eligible for that gratification(s) in the Circle where he/she was residing at the end date of Contest. The gratification to the winner will be done in the circle where he/she was residing at the time of awarding the gratification.

Prize(s) under this Competition shall not be transferable. No cash alternative for the prizes will be given by the Organizer. Mere participation in the Competition shall not entitle a Subscriber to a prize.  No other person or agent can claim the prize on behalf of the Winner, unless expressly specified herein.

All prizes offered in this contest are subject to availability. Airtel and One97 at their sole discretion can provide any other/ alternate prize in kind of equal or lower value as near to the original prize cost as an alternative to the prizes referred in Annexure A. Model or brand or color for alternate prize will be decided by One97 at its sole discretion, any choice of winner in respect to Model or brand or color will not be considered in any case. Also, no requests for upgrading any prize offered shall be entertained by One97 or Airtel.

The Subscribers understand that the prize/s under the Contest are sponsored and organized by One97. Airtel or One97 shall not be held responsible or liable for non-delivery or  quality of the goods or services being offered as prize/s or deficiency in the prize/s. Customer further understands that the goods provided as prize will carry manufacturer’s guarantee and in case of any deficiency in the goods, Subscriber will contact the manufacturer. One97 shall not be responsible in any way in case of manufacturer’s deficiency in resolving the problem.

The prize/s of the Contest will be given only to the winner/s in whose name the mobile phone number is registered. The winner needs to be the Airtel active subscriber at the time of receipt of prize/s and the winner should have cleared all the outstanding dues towards Airtel. To redeem the prize, the winner should declare his name & address and provide proof of identity, post paid bill or affidavit for prepaid users and other supporting documents valid 

All the registered Subscribers shall be able to download free content such as wallpapers & animations through WAP post completion of the competition, subject to terms and conditions which will be communicated through SMS on the phone number registered with Airtel. Data charges shall be applicable as per respective data plan of the MSISDN of the Participant.

 

These Terms and Conditions are subject to Indian law and shall fall under the exclusive jurisdiction of the Courts in Delhi.
